Another Eminent Domain Case Goes Supreme

A developer in Port Chester, NY had planning board permits to build a CVS pharmacy but also needed approvals from the private company hired by the city to redevelop this blighted zone. The company spokesman overseeing the zone told the developer that he would have to pay $800,000 or a give a 50% stake in the CVS, or they would seize the property under eminent domain and build a Walgreen’s instead. The developer refused, the city initiated action. Now it goes to the high court.
